Texas Driver's License Suspension

In Texas, when you are stopped for a DWI charge, the implied consent rules state if you refuse a breath test you could lose your license immediately for six months. Even if you do not refuse a breath test, failing a breath test means you could still be issued a suspension.

In addition, failing a breath test could result in prosecutors having access to more evidence against you. SUSPENSION NOT AUTOMATIC


In spite of what law enforcement officers may tell you, the suspension of your right to drive is not automatic. You have the right to an Administrative Hearing provided you request it within 15 days of your arrest. You also have the right to have an attorney present at this hearing and present a defense as well as question the law enforcement officer responsible for the suspension request.
